What's an impact witness?

The plaintiff's own testimony is easy to discount as self-serving and generic. Impact Witness is built to support a claim of attorney-client privilege and work product: moments are created during active representation, at your direction, to help prepare the case. Whether any given communication is protected is ultimately a legal determination for your firm. The architecture — no-training AI processing (store:false), encryption, and per-firm isolation — is designed to preserve that position. Two separate instruments back it: the SMS consent every client gives for text messaging, and a separate standalone client agreement — provided to your firm, signed at onboarding — that carries the privilege and work-product acknowledgment.

Is Impact Witness a generative-AI platform?

No — it's a documentation tool your firm uses to capture and organize your client's account during representation. It uses AI in a limited, behind-the-scenes role: categorizing each moment for the record and assembling a damages-narrative summary your attorney reviews. There's no inbox of drafts to clear — if your firm ever chooses to reply to a client, it can draft a suggested message on request, but nothing is generated or sent automatically. Client content is never used to train any model — every AI call sets store:false — and the AI never advises your client or messages them on its own.

It works exactly the same whether you're on Clio, CASEpeer, Filevine, or a legal pad. Native integrations may come later if firms want them, but the value lands without one: you get the damages story your file is otherwise missing, and you file it wherever you already work.

How does it work for the client?

What if my client doesn't text much?

If a client goes quiet for 3 days, your team gets an alert with a ready-to-send check-in the platform drafts for you. You approve and send it (and you can turn these reminders off per client once they're done treating). The AI never sends case messages on its own — your firm reviews and sends every substantive follow-up. The only automated texts are the simple ones your client opts into: a 'message received' receipt and a one-time welcome.

Won't my client feel surveilled — like we're monitoring them?

It's the opposite of surveillance. Surveillance is something done to you without your control. This is your client's own phone, on their own terms — they text when something happens and stay quiet when it doesn't. Nothing tracks them; the only automated message is a simple "received" receipt they opt into. What clients actually feel is heard. How is client data protected?

Every moment is handled as attorney-client work product. It's encrypted at rest and in transit (AES-256 / TLS 1.3), isolated per firm by Postgres row-level security enforced at the database — so no firm can ever see another's data — and processed by OpenAI with store:false, so prompts and responses are not stored for retrieval, and client texts are never used to train any model. Does the client have to type everything?

No — if they'd rather talk than type, they can use their phone's built-in voice dictation (the mic on the keyboard), which sends their words as a normal text. It all lands in the same timeline.

What about a client who isn't tech-savvy, is elderly, or doesn't speak English?

The bar is deliberately low — if they can send a text, they can use it, and texting is nearly universal across every age group. No app to download, no login, no new interface; it's the same messaging they already use with their family. For clients who'd rather talk than type, the phone's built-in voice dictation lets them speak and it sends as a normal text. And because every moment is just a text, a client can write in the language they're most comfortable in — Spanish, Vietnamese, any language. Your team reads each moment in English, and the client's original words are preserved in the record exactly as they said them. For the rare client who won't engage by phone at all, nothing's lost: your case is no worse off than it is today, while the clients who do engage hand you a record you'd never otherwise have.

Can I see what my client texted in real time?

Can my firm reply to a client, and where do the suggestions come from?

Yes — replying is always available, just never required. Clients use Impact Witness to log, and aren't expecting a back-and-forth. When you do want to ask something, tap "Draft with AI" on that moment: a 60-second intake at seat assignment captures injuries, treatment, and limitations, and the AI uses that context to draft an optional, injury-specific suggestion. Your attorney reviews, edits, and sends it — Impact Witness never questions or messages your client on its own.

What if a client texts something off-topic?

Impact Witness flags it as “other” and surfaces it for your review. Nothing case-relevant gets buried; nothing irrelevant gets included in the demand.
